1. Agreement to Terms
These Terms of Service (hereinafter referred to as "these Terms") set forth the terms and conditions for the use of CardHub (hereinafter referred to as "the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
These Terms are created in compliance with Apple App Store Review Guidelines and Japanese law (Consumer Contract Act, Personal Information Protection Act, etc.).
Relationship with Apple: This EULA is concluded between the developer and the End-User only, and not with Apple, and the developer, not Apple, is solely responsible for the Licensed Application and the content thereof. The EULA may not provide for usage rules for Licensed Applications that are in conflict with, the Apple Media Services Terms and Conditions as of the Effective Date (which you acknowledge you have had the opportunity to review).
2. Scope of License
The use of the App is provided as a non-exclusive, non-transferable license. You are permitted to use the App for personal purposes only.
Use on Apple Products: The license granted to the End-User for the Licensed Application must be limited to a non-transferable license to use the Licensed Application on any Apple-branded Products that the End-User owns or controls and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
- By downloading, installing, or using the App, you agree to this license.
- Commercial use of the App is restricted. Commercial use requires a separate paid license.
- Some features of the App may be offered through paid plans. In such cases, the terms of the paid plan apply.
- The App's code, design, and trademarks are protected by intellectual property rights.
3. User Obligations
- Legal Use: Please use the App in accordance with applicable laws and regulations.
- Accurate Information: Provide accurate information for user registration and use.
- Password and Account Protection: Properly manage your account information and passwords at your own responsibility.
- Device Management: The App stores information accessible only through devices. Be careful about device loss or theft.
4. App Features and Terms of Use
The App currently does not provide the following features:
- User Posting Feature: None
- Account Feature: None
- Social Features: None
If these features are added in the future, conditions will be clearly stated in these Terms or separate terms.
5. Prohibited Activities
Users are prohibited from engaging in the following activities while using the App:
- Illegal Acts: Acts that violate laws or regulations are prohibited.
- Unauthorized Access: Unauthorized access to the App or other users' data is prohibited.
- Copyright Infringement: Acts that infringe copyright or intellectual property rights are prohibited.
- Circumvention of Technical Restrictions: Circumventing or disabling technical protections of the App is prohibited.
- Harmful Acts: Acts that cause harm to other users or third parties are prohibited.
- Spam Acts: Solicitation, advertising, or dissemination of false information is prohibited.
If you violate these prohibited activities, the developer reserves the right to suspend use of the App or restrict accounts. In cases of serious violations, legal action may be taken.
6. Disclaimer of Liability
The developer is not liable for damages arising from the use of the App within the following scope:
- Direct damages: Damages directly resulting from use of the App
- Indirect damages: Damages indirectly resulting from use of the App
- Data loss: Damage resulting from user negligence
- Third-party acts: Damages resulting from acts or deficiencies by third parties
These are examples and do not cover all possible damages.
6-2. Warranty
The developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. The EULA must provide that, in the event of any failure of the Licensed Application to conform to any applicable warranty, the End-User may notify Apple, and Apple will refund the purchase price for the Licensed Application to that End-User; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the developer's sole responsibility.
6-3. Product Claims
The developer and the End-User acknowledge that the developer, not Apple, is responsible for addressing any claims of the End-User or any third party relating to the Licensed Application or the End-User's possession and/or use of that Licensed Application, including, but not limited to:
- Product liability claims
- Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of the HealthKit and HomeKit frameworks
The EULA may not limit the developer's liability to the End-User beyond what is permitted by applicable law.
7. Intellectual Property Rights
The App and its content and design are protected by copyright law and intellectual property rights.
Third-Party Intellectual Property Infringement Claims: The developer and the End-User acknowledge that, in the event of any third party claim that the Licensed Application or the End-User's possession and use of that Licensed Application infringes that third party's intellectual property rights, the developer, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
- App Content: The copyright of all app functions, screen designs, images, text, etc., belongs to the developer.
- User Data: Business card information and other data entered by the user is the user's property, and attention must be paid to intellectual property rights infringement.
- Prohibited Acts: Acts that infringe copyright or intellectual property rights are prohibited.
8. Support and Updates
The developer may update the App for feature improvements or bug fixes.
Apple's Support Obligations: The developer is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in the EULA, or as required under applicable law. The developer and the End-User acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
- These updates are intended to improve user convenience.
- Features may be deleted or changed due to updates, and these will be notified individually.
- Changes to these Terms will be notified within these Terms or on the website.
8-2. Legal Compliance
The End-User must represent and warrant that:
- (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and
- (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.
8-3. Third Party Terms of Agreement
The EULA must provide that the End-User must comply with applicable third party terms of agreement when using the Application, e.g., if you have a VoIP application, then the End-User must not be in violation of their wireless data service agreement when using the Application.
8-4. Third Party Beneficiary
The developer and the End-User acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of the EULA, and that, upon the End-User's acceptance of the terms and conditions of the EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against the End-User as a third party beneficiary thereof.
9. Changes to Terms
The developer reserves the right to change these Terms as necessary.
- Notification of Changes: For important changes, notifications will be sent via in-app notifications or on the App's website.
- Continued Use: Continued use of the App after changes constitutes acceptance of the modified Terms.
- Regular Review Users are requested to review these Terms periodically.

10. Governing Law and Jurisdiction
These Terms are created in compliance with Japanese law. Applicable laws and regulations include, but are not limited to, the following:
- Constitution of Japan, Personal Information Protection Act, Copyright Act, Unauthorized Computer Access Act, Consumer Contract Act, Specific Commercial Transactions Act, etc.
- We strive not to include unfair trade terms or terms invalid under the Consumer Contract Act, but these are examples and do not cover all possibilities.

12. Term of Agreement
This EULA is effective from the date the End-User first downloads, installs, or uses the Licensed Application and continues until the End-User uninstalls or deletes the Licensed Application.
13. Agreement to Terms
By downloading, installing, or using the App, you acknowledge that you have read and understood these Terms and agree to be bound by them.
